
Our scientist rejoins the Codification Commission of Civil Law
On May 14, 2024, 18 individuals received nominations to the Codification Commission of Civil Law from the Minister of Justice and Attorney General. Among them was prof. dr. hab. Piotr Machnikowski, Head of the Department of Civil Law and Private International Law at the Faculty of Law, Administration, and Economics of the University of Wrocław.
On May 14, 2024, 18 individuals received nominations to the Codification Commission of Civil Law from the Minister of Justice and Attorney General. Among them was prof. dr. hab. Piotr Machnikowski, Head of the Department of Civil Law and Private International Law at the Faculty of Law, Administration, and Economics of the University of Wrocław.
The members of the Commission were appointed by Prime Minister Donald Tusk, upon the recommendation of Minister of Justice Adam Bodnar, after consulting with professor Marek Safjan, Chairman of the Codification Commission of Civil Law.
As emphasized by the Minister during the nomination ceremony, there are numerous issues in civil and commercial law that the newly formed Commission should address. These include consumer rights, a review of legal provisions introduced during the pandemic, issues of civil-law protection of human rights, responses to problems that may arise from the spread of new technologies, including artificial intelligence, as well as the enhancement of commercial law to genuinely bolster entrepreneurship.
The previous Codification Commission of Civil Law, which also included prof. Piotr Machnikowski, was dissolved in 2015. The scope of the new Commission will encompass regulations in the broadly understood areas of substantive and procedural civil law, as well as commercial law. This particularly includes the Civil Code, the Commercial Companies Code, bankruptcy law, and the Code of Civil Procedure. The Commission will prepare assumptions and set general directions for changes and will draft legislative proposals to streamline the legislative process and contribute to the harmonization of Polish law with European law.
Prof. Piotr Machnikowski emphasizes that his appointment to this role is a recognition of the competencies and achievements of the Wrocław Center for Civil Law Studies. “I hope that with my knowledge and practical experience, I will be able to contribute to the modernization of Polish civil law, especially regarding legal relations connected with business activities,” says prof. Machnikowski. “The Commission’s priority will be to address the reform of civil procedure, which, after the changes made in recent years, significantly deviates from the expectations of legal practice and the standard of rights protection that the state should ensure for its citizens.”
