Minature for ‘guilt-free’ crime research

Dr Konrad Lipiński from the Department of Substantive Criminal Law at the Faculty of Law, Administration and Economics – received a grant in the Miniatura 8 competition for his project ‘Przestępstwa “bez winy”’.

I would like to deal with offences for which it is not even necessary to prove so-called negligence for a conviction, i.e. carelessness linked to the possibility of foreseeing its negative consequences, explains our lawyer. – These can be called ‘strict liability offences’ – we find them in Anglo-Saxon criminal law and they are a manifestation of a completely different approach to what goes on ‘in the head’ of the offender than the one we adopt in Poland. An example would be driving a car despite a revoked licence.

The aim of the project is to examine the peculiarities of this type of offence – in particular the reasons for which they are established – and to answer the question of whether and to what extent the doctrinal and case law acquis accrued in the common law system can be applied to the constructions developed in Polish criminal law.

To this end, I will go on a consultation trip to the University of Edinburgh and conduct a library search there – explains the researcher.

Dr Konrad Lipiński’s scientific interests include the issues of the perpetrator’s mental attitude towards the act (the so-called subjective side of the crime) and the attribution of criminal responsibility. The topic of the scientific activity combines both issues.

In the future – using the results of the research carried out – I would like to address the model of attribution of criminal responsibility for unintentional crimes – the researcher announces.

The aim of the MINIATURA competition is to support scientific activities that are the starting point for developing the premises of a research project, the financing of which can then be applied for in NCN competitions or other national and international competitions. During the eighth edition of the competition it was possible to obtain funding of between PLN 5,000 and PLN 50,000 for the implementation of an annual scientific activity. Read more:
