Konstytucyjny model ochrony sądowej w sprawach administracyjnych
Despite the summer break at the University of Wrocław, work in publishing is in full swing.
Apart from the famous premieres of books about football and Eybelwieser – a baroque painter from Wrocław, a new monograph by Marta Kłopocka-Jasińska, PhD in legal sciences, assistant professor at the Chair of Constitutional Law at the Faculty of Law, Administration and Economics, entitled ‘Konstytucyjny model ochrony sądowej w sprawach administracyjnych’ has been published recently.
As we read in the review by dr. hab. Marcin Dąbrowski, the book fills a gap in the science of constitutional and administrative law. For constitutional law, it is important insofar as it presents an analysis of the constitutional model of administrative judiciary. Such a research perspective is not often found in constitutionalism. The idea (successfully realised, by the way) of reconstructing the constitutional model of administrative judiciary deserves recognition and constitutes an important research contribution of the author to the dogmatics of constitutional law. At the same time, the monograph is very valuable for the science of administrative law. This is because it constitutes a comprehensive analysis of the functioning of administrative courts from the systemic point of view and the basic principles of a democratic legal state.
We strongly encourage you to read this publication: Konstytucyjny model ochrony sądowej w sprawach administracyjnych | Wydawnictwo Uniwersytetu Wrocławskiego (wuwr.eu) !
By addressing in detail the issues related to the differentiation of judicial protection and procedural guarantees, the author fills a gap in constitutional law research. She analyses the various elements of the right to a court, including the institutional, systemic and procedural guarantees set out in the Constitution. First and foremost, the guarantees of the right to have an administrative case heard by a competent, independent, independent and impartial court, as well as the right to proceedings that will be open and fair and the case will be decided without undue delay.
