Spór o Wyspy Kurylskie
Professor Rafał Czachor’s book Spór o Wyspy Kurylskie w perspektywie prawa międzynarodowego publicznego i stosunków międzynarodowych will soon be in print. A critical study. The book is the first comprehensive Polish-language study of the legal international and political conditions of the dispute. The author’s aim was not to undertake its resolution, but to discuss the historical premises, the legal arguments raised by both sides and the political motives of the ‘dead end’ currently taking place in the Kuril Islands issue.
The critical perspective of consideration adopted has made it possible to look at the conflict around the archipelago broadly. For law turns out to be only one of the regulators of social relations, including inter-state relations, and by far not the most significant one. The dispute over the Kuril Islands is an example of the rivalry between powers that try to hide their imperial ambitions behind legal arguments, remaining indifferent to the fate of those who do not fall into the category of ‘civilised nations’.
Looking beyond the usual patterns of territorial claims, the author draws attention to the fate of the Aynes, the hosts of the Kurils, who became extinct in the 20th century, which has been silenced by international law. The book fills a gap in knowledge about the legal and political conditions of the dispute over the archipelago. It also shows the extent to which contemporary international relations and law reflect historically and culturally conditioned relations based on patriarchy and violence.
