Legal basis for the activities of the Department of Defence Affairs:
- the Act of 21 November 1967 on universal duty to defend the Republic of Poland (consolidated text Journal of Laws, No. 4, item 16 of 1992 as amended);
- the Regulations of the Council of Ministers on civil defence;
- the Ordinances of Ministry of Culture and National Heritage on cultural objects in case of a threat to state security and armed conflict;
- the Ordinance of the Minister of Science and Higher Education on general principles of performing tasks in the field of defence in the Ministry;
- the guidelines of the Head of Civil Defence – President of Wrocław for activities in the field of civil defence of Wrocław;
- the Statute of the University of Wrocław; the Regulations for the Administration of the University of Wrocław
Legal basis for implementing civil defence tasks
The Act of November 21, 1967 on Universal Duty to Defend the Republic of Poland (Journal of Laws No. 241, item 2416 of 2004)
Decree of the Council of Ministers of June 25, 2002 on the detailed scope of responsibilities of the Head of National Defence, heads of provinces, districts and communes (Journal of Laws No. 96, item 850 of 2002)
Art. 137 The purpose of civil defence is to protect the population, workplaces and public utility facilities, historic monuments, to rescue and provide assistance to the injured in times of war and to co-operate in the fight against natural disasters and environmental threats and to remove their effects.
Art. 138.1 Civil defence formations shall be the basic organisational units assigned to perform civil defence tasks.
Art. 141 The obligation to serve in civil defence shall consist in:
1) serving in time of peace:
a) basic service or training of conscripts,
b) exercises;
2) active service in wartime.
Art. 141.1 The obligation to serve in civil defence is subject to:
1. Conscripts recognised as fit for military service, assigned to serve:
a) basic service in civil defence units, if they do not benefit from a deferment of basic military service;
b) training of conscripts in these units;
2. assigned to serve:
c) reserve soldiers not scheduled for military service or for service in militarized units;
d) men not subject to compulsory military service until the end of the calendar year in which they turn sixty years of age;
e) women starting from 1 January of the year in which they turn eighteen until the end of the calendar year in which they turn fifty.
3. The obligation to serve in civil defence shall not apply to:
1) people recognised as permanently or long-term incapable of working;
2) pregnant women and women in the period of six months until delivery
3) people taking care of children under eight years of age;
4) those taking care of:
a) children from eight to sixteen years of age,
b) chronically ill people,
c) people recognised as being permanently incapable of working and living independently
if these people reside together with them and this care cannot be entrusted to other people.
Legal basis for the implementation of civil defence tasks at the University of Wrocław
Pursuit to art. 138, item 3 of the Act of 21 November 1967 on the Universal Duty to Defend the Republic of Poland (Journal of Laws, No. 3, item 16) and § 42, item 1, 57, item 1, 58 and 60, section 1 of the Decree of the Council of Ministers of 28 September 1993 on civil defence (Journal of Laws No. 93, item 429) it is hereby ordered as follows:
§1. Civil defence at the University of Wrocław performs its tasks both in peacetime and in wartime.
1. The basic tasks of civil defence in peacetime shall include:
1) co-operating with the University authorities in counteracting natural disasters and environmental threats and removing their effects
2) carrying out planning and organisational activities, including the development of civil defence plans, their coordination and updating, and the organisation of civil defence formations
3) conducting training in civil defence in order to prepare the decision-making bodies of the University, members of the FOC and other persons for the performance of defence tasks
4) disseminating civil defence issues among employees of the University in order to prepare them for general self-defence
5) coordinating work related to the protection and safeguarding of cultural assets, the preparation of protective buildings and the implementation of other plans ensuring the functioning of the University in wartime.
2. The basic tasks of civil defence in wartime shall include:
1) the protection of employees and students, the property of the University and cultural goods, as well as the rescue and provision of assistance to those injured as a result of warfare;
2) receiving reports on dangers and making them known to employees and students
3) organising evacuation of the injured, providing them with medical first aid
4) coordinating work related to the protection of cultural assets and securing important documentation and scientific apparatus
5) making public reports on lighting dimming and extinguishing
6) supplying staff and students with equipment and personal protective equipment;
7) participating in rescue operations
8) protecting food and other goods necessary for survival
9) maintaining order in areas affected by disasters.
